The Administrative Prosecution is the only judicial authority authorized to investigate disciplinary contraventions, filing and directing disciplinary lawsuits before the courts of State Council and filing appeals on its judgments before the Supreme Administrative Court after reviewing those judgements to assure their validity, Where it conducts its judicial duties on behalf of the community as the Public Prosecution represents the community in criminal violations accordingly the law assured its independence from all Ministries and Public bodies to guarantee the impartiality of its members from the influence of senior public officials in a way that assures the rights of public employees under investigation besides the characteristics of Prosecution’s members in fighting corruption as:
1- Members of APA enjoy impartiality and independence from all administrative bodies in a way that guarantees the employees’ right in a fair investigation as its conducted by a judicial authority.
2- While conducting an investigation, members of APA are authorized to call witnesses to hear their statements, examining and collecting evidence and forming committees.
3- APA does not only determine the accountability of accused officials regarding disciplinary violations but it also aims to create practical means and solutions to eliminate corruption.
